Two structural facts reinforce that political framing over any legal or technical one. May 2027 is a rollover, not a cliff: COM(2026)311 extends non-EU incumbents to spring 2029 non-transferably, so SpaceX would not inherit EchoStar's EU standing even after that acquisition closes. And SpaceX's own ITU-priority claim is legally severable from the acquisition, which weakens its case and pushes the fight onto sovereignty grounds — SES/Lynk's strongest terrain.

SpaceX also undercuts its own "open access" framing — ITU priority against the EU's cap, then FCC exclusivity against Sateliot at home two months later — citable ammunition for SES/Lynk.
